DRAFT LAW ON EXPORT AND ENTRY OF VIETNAM CITIES

The Ministry of Public Security is drafting a draft Law on exit and entry of Vietnamese citizens

In the trend of international integration deepening and deepening, the flow of Vietnamese citizens going abroad to study, work, work, travel... is increasing (in 2016 it was 7.7 million, in 2017 increased to 9.2 million exits). To meet the needs of exiting from home to abroad and returning home from abroad, immigration management has been improved and simplified.

On the other hand, the Government has approved the project "Production and issuance of electronic passports in Vietnam", but currently there is no legal document regulating electronic passports. The development of a Law is essential to create a legal basis for the issuance, management and use of electronic passports. Therefore, the Ministry of Public Security is drafting a draft Law on entry and exit of Vietnamese citizens.

The Draft Law proposes new points as follows: The national database on exit and entry of Vietnamese citizens is connected to the national databases on population, citizen identity, crime, and nationality. citizenship and other databases to share, exploit and process information related to entry and exit of Vietnamese citizens.

Immigration documents

The draft also states that entry and exit documents include: a- Diplomatic passport; b- Official passport; c- Ordinary passport; d- Temporary passport; d- Passport.

Diplomatic passports and official passports are valid for not more than 5 years and may be renewed once for no more than 3 years. Ordinary passports are valid for no more than 10 years and cannot be renewed. Temporary passports are valid for no more than 1 year and cannot be renewed. A travel document has a term consistent with the duration specified in an international treaty to which Vietnam is a contracting party but must not exceed 01 year and cannot be extended.

In addition, diplomatic passports, official passports and ordinary passports are fitted with an electronic chip to store information about biometrics, identity of the grantee and digital signature of the issuing agency.

New type of entry and exit paper

The draft regulations on new types of entry and exit papers are as follows: temporary passports instead of travel documents. A temporary passport is valid for 1 year, valid for use like an ordinary passport, and is issued to Vietnamese citizens in the following cases: use, have the desire to return home immediately; b/ Not being allowed to reside abroad, voluntarily applying to return home without a valid passport; c/ Not allowed to reside abroad, there is a written expulsion decision from a competent agency of the host country; d/ Having to return home according to an international treaty between Vietnam and the host country on the return of citizens; dd) For reasons of national defense and security under the decision of the Minister of Public Security.

The addition of provisional passports is an affirmation of the protection of the State of the Socialist Republic of Vietnam for citizens in the above special cases, because of objective conditions, it is impossible to meet the provisions of law. long-term passports.

Regarding competence, the issuance of temporary passports is mainly assigned to the superior Vietnamese representative missions abroad on the basis of discussions with the Immigration Department of the Ministry of Public Security.

In addition, the cases of being granted a travel permit include: a- Vietnamese citizens wishing to exit to countries sharing a border with Vietnam under a bilateral agreement; b/ Vietnamese citizens wishing to exit to countries under international treaties to which Vietnam is a contracting party.
